Terms of Use

Law Office of Simran S. Tiwana

Welcome to the website (the "Site") of the Law Office of Simran S. Tiwana ("the Firm," "we," "us," or "our"). By accessing or using the Site you agree to be bound by these Terms of Use (the "Terms"). If you do not agree, please do not use the Site.

"You" and "User" mean anyone who accesses or uses the Site, including on behalf of an organization. You must be 18 or older to use the Site.

1. General Information Only – Not Legal Advice

The Site is provided for general informational purposes only and does not constitute legal advice. Nothing on the Site creates an attorney-client relationship, and you should not act or refrain from acting based on it without consulting a lawyer licensed in your jurisdiction.

While we aim to keep the Site useful and current, we cannot guarantee its accuracy, completeness, or applicability to any situation, and we disclaim all representations and warranties regarding the Site and its contents.

2. No Attorney-Client Relationship

Using the Site or sending us information through it does not create an attorney-client relationship. If you are not already a client, anything you send us is not confidential or privileged and will not create such a relationship. We cannot agree to keep unsolicited information confidential unless and until a relationship is formally established, which requires a conflicts check and mutual agreement on representation – and we may decline to represent you even absent a conflict.

If we already represent you and you email us about a pending matter, note that internet email is not fully secure; sending unencrypted sensitive information means accepting that risk.

3. Attorney Advertising / Jurisdictional Compliance

This Site may constitute advertising under the ethical rules ("Bar Rules") of some jurisdictions. Our attorneys are licensed and practice only in the jurisdictions stated in their biographies, and we do not hold ourselves out as qualified elsewhere. If this Site does not comply with the Bar Rules where you access it, we do not seek to represent you based on your viewing it. Unless noted, our attorneys are not board-certified specialists.

4. Proprietary Rights

We own all right, title, and interest in the Site and its content ("Site Content"), including all related intellectual property. Nothing in these Terms grants you a license to that property. Site Content may not be copied, reproduced, distributed, or otherwise used without our prior written permission; unauthorized use may violate copyright, trademark, or other laws.

Any content you submit ("Your Content") must be accurate, and you are solely responsible for it and agree to indemnify us against related claims; we have no obligation to review it. Use caution disclosing personal information online. Any feedback or suggestions you send us become our exclusive property.

5. Prohibited Conduct

You agree not to use the Site to:

  • Damage, disable, overburden, or interfere with the Site or others' use of it;
  • Gain unauthorized access through hacking, password mining, or similar means;
  • Transmit viruses or other destructive code;
  • Defame, harass, stalk, threaten, or violate others' legal rights;
  • Post unlawful, infringing, or obscene content;
  • Scrape, crawl, or use automated tools to collect Site content or data;
  • Impersonate any person or entity, or falsify attribution notices;
  • Remove proprietary notices from the Site;
  • Falsely imply sponsorship or endorsement by the Firm;
  • Use the Site for any commercial purpose; or
  • Use the Site for any unlawful purpose or to promote harm to any person or group.

We may restrict, suspend, or terminate your access at our discretion for violating this Agreement.

6. Third-Party Links

The Site may link to third-party sites or resources ("Outside Materials") we do not own or control. Links are for convenience only and do not imply our endorsement or any partnership with the linked party. We are not responsible for the content or practices of linked sites, which have their own terms; direct any concerns to the relevant third party.

7. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or that its content will be accurate or reliable, and we are not liable for interruptions caused by factors outside our control. We have no obligation to update Site information except as required by law; you are responsible for the security of anything you transmit to the Site and for verifying any information you obtain from it.

8. Limitation of Liability

IN NO EVENT SHALL LAW OFFICE OF SIMRAN S. TIWANA, ITS AFFILIATES OR ITS LICENSORS, TOGETHER WITH THEIR RESPECTIVE EMPLOYEES, AGENTS, PRINCIPALS, OWNERS, DIRECTORS, OFFICERS, AND/OR SHAREHOLDERS, BE LIABLE WITH RESPECT TO ANY SUBJECT MATTER OF THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE) FOR ANY LOST OR CORRUPTED DATA, LOST PROFITS, LOSS OF USE, LOSS OF DATA, LOSS OF OTHER INTANGIBLES, OR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, EVEN IF LAW OFFICE OF SIMRAN S. TIWANA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS SHALL ONLY APPLY TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAW.

9. Modifications to These Terms

We may update these Terms at any time by posting the amended version on the Site, effective upon posting. Material changes may be flagged on the homepage, but you are responsible for checking back periodically; continued use after an update means you accept it.

10. Miscellaneous

This Agreement is the entire agreement between you and us regarding the Site and supersedes prior understandings. If any provision is found invalid, it will be construed to reflect the parties' original intent while the rest remains in effect; our failure to enforce a provision is not a waiver of it.

The Site targets visitors in the United States. It may be accessed elsewhere, but we make no representation that it is appropriate for use outside the U.S., and visitors who do so are responsible for compliance with local law.

Governing Law; Forum. These Terms are governed by the laws of the State of California without regard to conflict-of-law provisions. You and we consent to the exclusive jurisdiction of the state courts in Los Angeles, California for any related dispute.
